Prices: Prices herein are for the Wholesale Trade only, and cancel all previous lists. Prices are subject to change without prior notice. All prices FOB Semmes.

Reserved Stock: We will hold stock for 30 days, however we require a 25% deposit at the time plants are selected.

Terms: Cash or satisfactory references before shipment to unestablished accounts. Service charge of 1.5% per month on outstanding balance if payment in full is not received by the 30th day following invoice date. Thirty percent will be added to the total amount of invoices turned over for enforced collection. All shipments travel at risk and cost of purchaser.

Limited Warranty: If a defect in nursery stock manifests itself within ten days of delivery to purchaser, written notice and proof thereof is given to seller within reasonable time not to exceed twenty days from the time of delivery to purchaser, seller will replace stock or refund the purchase price. This is the only warranty made by seller and the only remedy available to purchaser for breach of warranty; seller is not responsible for any incidental or consequential damages. Seller makes no other warranties, expressed or implied; Seller expressly disclaims any and all warranties of merchantability or fitness for any particular purpose. The employees of seller have no authority to orally waive or modify any of the provisions of this limited warranty; any changes must be by written instrument executed by a duly authorized officer or seller.

Exceptions: All orders are accepted subject to growth of stock and seasonal and other conditions not under our control.
